Update:  Prison guard arraigned in "swingers" fraud case

SACRAMENTO, CA (AP) -- Correctional officer John Smiley had told colleagues that he was shot by a former inmate outside a San Francisco restaurant, apparently to avoid embarrassment over the fact that he actually was shot during a dispute at a sex club.

 

 

SACRAMENTO, CA (AP) -- Correctional officer John Smiley had told colleagues that he was shot by a former inmate outside a San Francisco restaurant, apparently to avoid embarrassment over the fact that he actually was shot during a dispute at a sex club.

The cover story worked, until he used it to file a workers' compensation claim for the injury, which left him paralyzed from the waist down.

The state was about to pay a settlement when officials requested a copy of the police report, and an investigation into the April 2008 shooting followed.

Now Smiley and his wife, Cynthia Ann Biasi-Smiley, face five felony counts alleging they conspired to commit fraud. The couple are due in Sacramento County Superior Court on Wednesday for arraignment.

A phone message left at the couple's home Monday was not returned.
