PLACERVILLE, CA - The El Dorado County District Attorney's Office will not seek the death penalty for Steven Colver who is accused, along with girlfriend Tylar Witt, of killing Witt's mother last June.

Colver, 20, and Witt, 15, are alleged to have murdered Joanne Witt in her El Dorado Hills home last June 11 or 12.

Prosecutors have argued the couple conspired to kill Witt's mother after she threatened to press statuatory rape charges against Colver.

Colver and Witt are also facing two special enhancements of lying in wait and killing a witness.

The district attorney's office decided against seeking the death penalty for Colver because of his age and because he has no prior record.

At a hearing Friday morning in Placerville, the defendants agreed to waive their right to a speedy trial. Judge Kenneth Melikian set their next appearance in court for Feb. 1.
